Public Administration || Paper 2 || State Government and Administration


State Govt.
1.   As per 7th A. Act, two states can have one Governor.
2.   Art 166 deals with allocation of work.
3.   Art 200 refers to reservation of bill for President by the Governor.
4.   Art 213 deals with the provision of an Ordinance.
5.   Art 161 deals with relief – Pardon, Commutation, Respite, Remission and Reprieve.
6.   Governor needs to send a fortnightly report on constitutional status.


Normal Constitutional Discretion
1.   5th Schedule Areas except the states of AMTM ; Tribal Advisory Council;
2.   6th Schedule – AMTM – Assam, Meghalaya, Tripura and Mizoram; District Tribal Council; Judicial and legislative powers; Representative Body;

2.   Centrifugal Force – Good via. Decentralization; Bad via. Separatism;
3.   A balance would help us move from Confrontational federalism to Cooperative federalism;

National Emergency Art 352
1.   Parliament can legislate.
2.   Can’t dismiss State govt.
3.   In cases of War, external aggression and armed rebellion;
4.   Can continue indefinitely;
5.   Can suspend FRs; Art 358- automatic suspension of Art 19; Art 359 says Art. 20 & 21 cannot be suspended;
6.   Approval in 01 month; renewal in 06 Months;


State Emergency Art 356
1.   UG can delegate powers/functions.
2.   SG can be dismissed and suspended;
3.   In case of failure of constitutional machinery;
4.   For a maximum of 03 years.
5.   No suspension of FRs.
6.   Approval in 02 months; renewal in 06 months.
